These Terms & Conditions (“Terms”) govern the relationship between 3C Projects and its clients. By accepting a quote, confirming a booking, or commissioning any work, you agree to be bound by these Terms.
1. Definitions
In these Terms, the following terms have the meanings set out below:
- “3C Projects” / “we” / “us” — 3 Corners Crafting and Build, trading as 3C Projects.
- “Client” / “you” — the individual or organisation commissioning services from 3C Projects.
- “Project” — any renovation, fit-out, or construction work agreed between 3C Projects and the Client.
- “Inspection” — a home or property inspection service provided by 3C Projects.
- “Quote” — a written price estimate issued by 3C Projects for a defined scope of work.
- “Agreement” — the binding contract formed when both parties accept a Quote in writing.
- “Variations” — changes to the agreed scope of work requested by either party after an Agreement is formed.
2. Our Services
3C Projects provides the following services:
- Home Renovation — residential refurbishment, remodelling, extensions, and fit-outs.
- Home Inspection — pre-purchase, pre-sale, and periodic property condition assessments.
- Commercial Renovation — office fit-outs, retail refurbishments, and commercial interior works.
All services are subject to a written Agreement or confirmed booking. We reserve the right to decline any enquiry or project at our discretion.
3. Quotes & Estimates
All quotes are provided in writing following a site visit or detailed consultation.
- Quotes are valid for 30 days from the date of issue unless otherwise stated.
- A quote becomes binding only when accepted in writing (email acceptance is sufficient) and a deposit is paid.
- Verbal estimates are for indicative purposes only and do not constitute a binding quote.
- Quotes are based on the information available at the time. If unforeseen conditions are discovered on-site (e.g. hidden structural issues), additional costs will be discussed and agreed before proceeding.
- All prices are quoted exclusive of applicable taxes unless explicitly stated otherwise.
4. Payment Terms
Renovation projects
- Deposit: 30% of the agreed project value is due upon acceptance of the quote, before work commences.
- Progress payments: Further staged payments are due at agreed milestones as set out in the project Agreement.
- Final payment: The remaining balance is due upon practical completion and handover.
Inspection services
- Full payment is due at the time of booking confirmation, or as otherwise agreed in writing.
- The inspection report will be delivered upon receipt of full payment.
Late payment
- Invoices are due within 14 days of issue unless otherwise agreed.
- Overdue invoices may incur interest at the applicable statutory rate, calculated daily.
- We reserve the right to suspend work on any project where payment is overdue by more than 7 days, without liability to the Client.
5. Project Conduct & Access
- The Client must ensure that 3C Projects has safe and unobstructed access to the property for the duration of the project.
- The Client is responsible for removing personal belongings and valuables from work areas before work commences, unless otherwise agreed.
- Utilities (water, electricity) must remain connected to the property during the works unless prior arrangements are made.
- 3C Projects will take reasonable care to protect areas of the property not included in the scope of work.
- All work will be carried out during normal business hours unless otherwise agreed in writing.
- The Client must promptly inform 3C Projects of any known hazards on the property (e.g. asbestos, gas leaks, structural concerns).
6. Variations & Changes
Any changes to the agreed scope of work must be requested and approved in writing before being carried out.
- Variations may affect the project cost and/or timeline. A revised quote or variation order will be provided before additional work proceeds.
- We cannot guarantee the original completion date if significant variations are introduced mid-project.
- Work carried out at the verbal request of the Client without a written variation order will be charged at our standard day rates.
7. Completion & Handover
- “Practical completion” means the works are substantially finished and the property is fit for use, even if minor snagging items remain.
- A joint inspection will be carried out at practical completion. Any agreed snagging items will be recorded and rectified within a reasonable timeframe.
- Final payment is due at practical completion, not conditional on snagging resolution unless otherwise agreed.
- Risk in the works passes to the Client upon practical completion.
- Where applicable, we will provide relevant certifications, warranties from manufacturers, and compliance documents at handover.
8. Home Inspection Terms
Our home inspection service provides a professional assessment of the visible and accessible condition of a property at the time of inspection. The following limitations apply:
- Inspections are visual assessments only. We do not perform invasive, destructive, or specialist testing unless specifically agreed.
- The inspection report reflects the condition of the property on the date of inspection only.
- We are not responsible for defects that were not visible or accessible at the time of inspection, or that arose after the inspection date.
- An inspection report is not a structural engineering report, a valuation, or a legal survey. The Client should obtain appropriate specialist advice for any concerns identified.
- Our liability for any inspection is limited to the fee paid for that inspection. See Section 10 (Liability).
An inspection report should be used as one input in your decision-making process, not as the sole basis for a property purchase. We strongly recommend seeking additional specialist reports for any significant concerns raised.
9. Cancellation & Postponement
Cancellation by the Client — renovation projects
- Cancellation more than 14 days before the scheduled start: deposit is forfeited; no further charges.
- Cancellation 7–14 days before start: deposit plus 10% of the remaining contract value.
- Cancellation within 7 days of start, or after work has commenced: deposit plus all reasonable costs incurred to date, including materials ordered and labour committed.
Cancellation by the Client — inspections
- Cancellation more than 48 hours before the inspection: full refund.
- Cancellation within 48 hours: 50% of the inspection fee is retained.
- No-show or cancellation on the day: full fee retained.
Cancellation by 3C Projects
We may cancel or postpone a project due to circumstances beyond our control (force majeure, health and safety concerns, non-payment). In such cases we will provide as much notice as possible and will refund any payments made for work not yet carried out.
10. Liability & Insurance
3C Projects carries appropriate public liability and professional indemnity insurance. Details available on request.
- Our total liability for any claim arising from a renovation project is limited to the value of the contract for that project.
- Our total liability for any claim arising from a home inspection is limited to the fee paid for that inspection.
- We are not liable for indirect or consequential losses, including loss of profit, loss of use, or loss of opportunity.
- We are not liable for damage arising from conditions that were pre-existing, not accessible, or not within the agreed scope of work.
- Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
11. Warranties & Defects
- We warrant that all renovation work will be carried out with reasonable skill and care, and will be free from material defects for a period of 6 months from the date of practical completion (“Defects Liability Period”).
- Any defect notified to us in writing during the Defects Liability Period that is caused by our workmanship or materials will be rectified at no additional cost.
- This warranty does not cover fair wear and tear, damage caused by the Client or third parties, or issues arising from failure to follow maintenance instructions.
- Manufacturer warranties on materials and products are passed through to the Client and are subject to the manufacturer's own terms.
12. Disputes
We aim to resolve any concerns quickly and fairly. If you have a complaint:
- Contact us in writing at [email protected] with full details of your concern.
- We will acknowledge your complaint within 5 business days and provide a full response within 21 days.
- If we cannot resolve the complaint directly, either party may refer the dispute to mediation before initiating legal proceedings.
These Terms are governed by the laws of the Province of Ontario. Any disputes not resolved by mediation shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
13. Website Use
Our website (www.3cprojects.ca) is provided for information purposes. While we take care to keep it accurate and up to date:
- We make no warranties that the website will be uninterrupted, error-free, or virus-free.
- Content is subject to change without notice.
- Links to third-party websites are provided for convenience; we are not responsible for the content or practices of those sites.
- You may not copy, reproduce, or distribute content from our website without prior written permission.
Use of the contact form on our website constitutes acceptance of our Privacy Policy.
14. General Provisions
- Entire agreement: These Terms, together with any written project Agreement or booking confirmation, constitute the entire agreement between the parties.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any term does not constitute a waiver of that term.
- Assignment: The Client may not assign their rights or obligations under an Agreement without our prior written consent.
- Updates: We may update these Terms from time to time. The version in force at the time your project Agreement is signed will apply to that project.
- Consumer rights: Nothing in these Terms affects your statutory rights as a consumer where applicable.
